CONSTITUTIONAL AND ADMINISTRATIVE LAW

Practice in this area includes: analysis of the file and authorization requirements regarding mergers and acquisitions, including both domestic and international transactions (with implications in Uruguay); study of the impact of various antitrust practices involving pricing policies; consultancy on the spectrum of permitted activities under competition laws. Bergstein successfully represented an international trademark owner in the leading case involving competition laws, trademark protection, gray market and unfair competition. The firm is frequently called upon to represent companies involved in administrative proceedings conducted by the regulatory body, the Competition Promotion/Defense Commission.

The representation includes the assistance in government procurement procedures, filing of administrative appeals, applications for regulatory permits, and legal defenses in connection with the imposition of administrative sanctions.

Some of the relevant matters in which Bergstein has participated include:

  • Legal assistance to a foreign company in an international public tender for the acquisition and implementation of a system for the issuance of electronic identity cards.
  • Legal assistance to a multinational company in the public tender for the acquisition of passport booklets (with chip) to be issued in Uruguay.
  • Legal support to a New Zealand company in its successful participation in an international public tender for the supply of livestock electronic identification tags in Uruguay.
  • Disciplinary administrative proceedings.
